I believe Alistair's point here is that whatever system of justice you come up with within your societal model, there is a loophole in it. This would inevitably give rise to a profession whose job it is to find these loopholes and either plug them, or use them on their clients behalf. This inevitably leads to a system of justice so complex that only these individuals can understand it. This is trivially obviously a sign that a societal model is sick and unworkable, and hence libertarianism is discredited. QED.
